Legal Question in Traffic Law in California

Driving without a valid driver's license nor insurance

My mother insists on driving without a valid driver's license. It has been revoked. Her insurance was cancelled because of this. If she drove and was involved in an accident, regardless of whose fault, what repercussions would ensue? Could she be sued for all she's worth, which is considerable?

Thanks for your posting.

Driving without a driver's license or insurance are both crimes. If there is an accident, then the cases may be filed as felonies, which can lead to up to 3 years in state prison or more, depending upon her record.

A lawsuit can also be filed, and since insurance will not pay, she is personally responsible for anything that happens to her.

The short story is: Don't drive without either a license or insurance. All of us who practice law have many sad stories of persons who chose to drive without either.

Thanks again, and if you have any other questions or need more information, please feel free to call me at 1-877-568-2977 (toll free) or email me, and I'll help in any way that I can.

She is taking a major risk. Not only is her liability high - she is committing a crime each time she drives. Driving with a revoked license is considered Aggravated Unlicensed Operation - which is a Misdemeanor. It is much worse than simply driving without a license.

Your mom is comitting a crime every time she drives. If she gets into an accident, she may even be facing jail time, besides the fact that if injuries occur she would face loosing her money.
