Legal Question in Traffic Law in California
Regarding At Fault Auto Accident
We were recently involved in an auto accident that was our fault; I was with my father driving at the time during a dark rainy night. He slightly rear ended a car due to sliding while breaking. I had exited the car first to consult the other driver and provided him with my info including license and the cars insurance card, my father had difficulties exiting the car but later was able to exit and consulted the other driver.. We have no problems in paying the dues but the problem is that I was reported to be the driver and I was uninsured at the time while my dad countered this and rightfully claimed himself as the driver. He was accused of lying although they had no evidence nor was police at scene. So now there is a DMV claim filed saying I had an accident while uninsured and supposedly another one on my dad because he was accused of lying. We face the risk of having our licenses suspended for multiple years. . I am asking for any advice you can offer to help us clear our names and continue our livelihoods in a normal fashion, we have absolutely 0 other crimes and previous accidents.

Re: Regarding At Fault Auto Accident
You need to consult with an attorney and determine what evidence you have that your father we the driver and not you. Then present this evidence to the department of motor vehicles. Generally if there is claim that you were driving without insurance a ticket is issued and you have to go to court regarding the incident.
