Legal Question in Traffic Law in California
Whose fault is this?
I was driving down an expressway and
turning left at a light. There was one car
ahead of me at the time. When the light
turned green we both started to go he
unexpectly stopped to turn an
immediate left into his driveway (his
house was on the corner) crossing a
double line. My car was in the
intersection when this was happening I
slammed on the brakes but still hit the
car. I know that the driver in back is
usually at fault but there is no way I
could have told he was turning and my
car was in the intersection still coming
out a turn. Whose fault is this?

Re: Whose fault is this?
Typically, if you have an accident with someone that is breaking the traffic laws they will be, at least partially, at fault.
