Legal Question in Traffic Law in California
fighting a vc 23111 ticket?
My husband was pulled over by a CHP (car) officer on the fwy for ''ashing'' out his window. (daytime) Since he has never smoked a cigarette he told the cop to search his car. He doesn't even have a car lighter. The cop laughed at him and walked away. He has a letter from his doctor and one from his dentist stating he doesn't smoke. Will this be enough proof for the judge? He had just left work so his employees can verify that he didn't leave with one.'The cop prob won't remember since he was there for about 3 min total, so I'm assuming he will have a different story.

Never, ever invite a cop to search your car. Fight the ticket and see if he shows up.
