Legal Question in Traffic Law in California

Freeway Collision

I recently got into an accident where a woman in her car cut me off in my lane without looking only to see the traffic in front of her stop, thus causing her to stop. Because of the short space between our cars, I ended up rear ending her. My car was uninsured at the time and I have agreed to pay for her damages. Even if she cut ME off, is it my fault? Also, since the accident, my wrist has swollen and developed a sort of bulge. Can I take it to litigation in regards to the growth on my wrist? It has since impeded the full extension of my fingers on my right hand. This is an issue also because of the fact that I work as a golf instructor.

Re: Freeway Collision

Under the facts that you describe she should be at fault as she pulled in front of your too close. Even if you were not insured you can sue for medical costs and lost wages, actual out of pocket expenses. You could not collect for pain and suffering. You should have a doctor examine your wrist to determine what is causing the swelling. If the swelling is related to the accident then notify the other driver's insurance of your injury, and the projected medical expenses associated with that injury.
