Legal Question in Traffic Law in California

Howdy,

My nephew's CA drivers license was revoked for unpaid tickets. What should we expect to encounter at the hearing? Should he have an attorney?

Would definitely help to have an attorney. The issue needs to be resolved from the base. We need to get all his tickets taken care of and make sure he will not obtain too many points to avoid a huge raise in his insurance premiums. An attorney would definitely help.

When you say "revoked", I assume you mean suspended. The (sort of) good news for your nephew is that there is a traffic amnesty program that may greatly help him. It used to be that if your license was suspended for failing to pay, you had to pay off the fines completely before they'd release the hold on your license. Not so any more. Once he appears in court (or an attorney on his behalf), he may be able to get on a payment plan, but also to get the hold lifted so he can get his license reinstated so he doesn't keep ending up with suspended license cases over and over. There may also be a reduction on the total amount due as well.

Yes, an attorney may help to make sure it's done smoothly.

If these cases are already resolved, then it's a matter of working out the details. If they're open cases, it's a little more tricky because too many convictions for moving violations can rack up "points" on his license that can get is suspended for too many points.

It's at least worth a conversation wth a traffic ticket attorney to discuss his options.
