Legal Question in Traffic Law in California

Am I at a loss?

Im interested in finding out information about small claims court. My vehicle was in an accident, the car that hit me was not insured, and i wasnt either. The driver of the other vehicle signed a contract stating that he was at fault and agrees to pay me money. My question relates to the judge. If he/she asks me about my insurance, and me stating i dont have any, will she/he throw my case out?? or review the case as a contractual issue? strictly only cause it is a contract that was not fulfilled, not insurance.

Whether either of you are out of compliance with state proof of responsibility requirements will have no bearing on the issue of whether somebody is negligent and caused damage to the other. Keep in mind that fault can be apportioned.

It is my understanding that you can collect money damages, if you are uninsured, but you cannot collect damages for personal, or bodily injury.
