Legal Question in Traffic Law in California
OFFICER wrote the wrong license plate number on my speeding ticket
hi Lawguru and THANK YOU for hearing my case.
the officer forgot to include THE LAST DIGIT of my license plate when he wrote the citation. no surprise: during a busy afternoon, he pulled me over on one of the scariest shoulders of highway 17 north near the summit of a mountain, just before santa cruz county turns into santa clara county, and was probably nervous as heck with all that traffic flying by. he arbitrarily picked me from a bunch of speeders. how absurd.
so, i requested a TRIAL BY DECLARATION form from the county and plan on claiming I was not there and that that must have been someone else. is that the smartest way to go on this? or do you recommend another avenue to beat this ticket? any help would be appreciated!

Re: OFFICER wrote the wrong license plate number on my speeding ticket
Your question reminds me of an attorney in Santa Clara County about 20 years ago. He decided that stating under penalty of perjury that he owned a business in Oregon, to avoid paying the car registration penalties. When the distric attorney dicovered that the address of his business in Oregon was an empty lot, a complaint for perjury was filed. Thereby changing a infraction or misdemeanor to a felony. Your best bet is to be honest. Go to Nolo Press and purchase their book on How to Fight Your Traffic Ticket.
