Legal Question in Traffic Law in California
Parking lot collision
I was backing out of a parking spot at work and collided with another car that was bacling out as well. I started to back out first and was already facing the exit when the car behind me started to pull out. He was still facing his parking spot. The rear of my truck hit the rear quarter panel of his car. During talks to my insurance company, I was told that California has a law that states that both parties are 50% liable for damages when they are both backing out at the same time. I have never heard of this law. Please let me know if this is really the case. Thank you

I know this is not going to be terribly helpful to you, but I have never heard of such a law either.
In situations like the one you describe, there exists a factual dispute as to who is more culpable, if at all.
Are you sure the insurance company was not just referencing one of their internal policies?
