What if the other party in fault do not want to pay for the rental car?

3 weeks after I was rear-end by this police man in his private vehicle, the insurance of this party called me and let me know that the Insurance company will not accept the claim from him as he did not pay for the month..I have been driving a car around as I did not know what would come out, and if my car was reparable or not. So my insurance took care of everything exept the majortiy of rental car..The party in fault refused to pay for the rental car...Can I take him to small court? Will I have a strong case?

You can as long as you didn�t sign a release with the insurance company.
