Pedestrian right of way

If a pedestrian walks into the middle of traffic, where there is no intersection or cross walk, basically into the middle of the street and gets hit by a car, does the pedestrian right of way still apply?

I think you are asking whether the pedestrian would still have a claim against the driver for the pedestrian's injuries. The answer is, "maybe." It would depend on a whole lot of factors - like the nature of the roadway, the driver's behavior, etc. You can give me a call if you would like to discuss.
