Rear End Collision causing Rear End Collision

My wife was incolved in an auto accident on the freeway, in which traffic stopped in front of her, thus causing her to stop. The vehicle behind her did not stop in time, hit her, causing her vehicle to rear-end the vehicle in front of her.

Is my wife responsible for hitting the car in front of her, or is all of the liability held by the party that rear-ended my wife?

from the facts given, the driver behind your wife's car put the force into motion that actually and proximately caused your wife's vehicle to hit the car in front of her. thus, this would not be a volitional act on the part of your wife and conseqquently she would not necessarily be liable for any damages her car caused the other vehicle. i strongly suggest you contact me with more facts so we can make sure your wife is not liable in any way, shape, or form.

Thank you for your posting.

With multiple car collisions, sometimes fault is apportioned in percentages (which in my opinion is not consistent with California law, but adjusters seem to like apportionment). If the driver behind failed to slow down, and hit your wife, that would be the cause if both cars in front were stopped. If your wife stopped suddenly, and did not pay attention in enough time for the car behind to stop reasonably, then theoretically, she could be at fault.
