Legal Question in Traffic Law in California

Rearended in commuter lane by single person
The car accident was a year and a half ago in Santa Clara County, California. I am now 22 years old. A single man was in the commuter lane(*going about 55-60) and PLOWED into my BF and I who were stopped with traffic. I had to go to a hospital that my insurance didnt cover, so I had to wait for a bill. After a year of asking me to wait, the hospital let me know that I do not exist in their systems, so I do not have a bill. Since I dont have a medical bill, and I have had to work on getting it for so long.... still having occasional back spasms and problems even now... how much would you ask for?What is the name of your state?
