Legal Question in Traffic Law in California

My son received a ticket for California 24400. He was driving home from school in the rain with his windshield wipers on. His headlights were not on. However, he was driving a 2000 Toyota Camry with automatic daytime running lights that were functioning (on). Are the daytime running lights a valid substitute for headlights? Is this a reasonable defense or should we just pay the ticket?

Legally it is not a sufficient defense. A judge might accept it for a reduction in the fine. Many traffic court judges will announce at the beginning of the court session that if you plead guilty and have the funds to paid the fine within the next few days, they will cut the fine in half. There are just too many cases for them to hear so they want to dispose of them as quickly as possible. So wait until the hearing date to see what offer the judge will make.
