Legal Question in Traffic Law in California
Right to a speedy trial.
Recently I got a ticket for obstructing traffic. Construction immediately on the opposite side of an intersection. The police were pulling people left and right. I decided to fight it, so I went down to the court to get a court date. Within the blizzard of paperwork I had to go through, was a paper with a prechecked box indicating that I give up my rites to a speedy trial. When asked I was told that it was necessary because the court system is so backed up. My questions are:
1.) Is that my problem?
2.) If I refuse to sign, and maintain my rights what is a ''Speedy'' trial?
3.) What happens if my court date is not in a reasonable amount of time because of the backlog?

No, it's not your problem. I would cross out the pre-checked box and write "SPEEDY TRIAL DEMANDED." If you encounter any problems feel free to contact me.
