Legal Question in Traffic Law in California

Stop sig ticket

Hi, I got pulled over in Orange County California because, according to the officer, I did not come to a complete stop at a stop sign (on a right turn). The cop car was parked in a part of the intersection that does not allow parking (red line painted on the sidewalk) and was creating a dangerous hazard for the cars driving in the area because it was blocking the entire lane and people driving in that direction had to switch to the other lane (opposite traffic direction) crossing a continuous double line in order to proceed. The road is very narrow.

Being in that position with his car the cop was violating the law. On these bases, do I have ground to ask for a dismissal of the ticket?

Probably not. You may have a defense that he was not being attentive to cars at the intersection, as he was or should have been concerned about his own safety. Check the Nolo Press book How to Fight Your Traffic Ticket.
