Legal Question in Traffic Law in California
Traffic Accident a semi truck made a left turn and collided on the passenger side of my vehicle. I was in the left turning lane at a complete stop waiting for the traffic in front of me to me. The traffic collision report from the San Bernardino County Sherrif Dept states cause of accident "It was determined that Driver #1 (Truck) caused this collision by violating CVC22107 of the California Vehicle Code. The following is a brief summary under California Vehicle Code: "No person shall turn a vehicle from a direct course and move right or left upon a highway until such movement could be made with reasonable safety and then only after giving an appropriate signal in a manner provided in thei chapter in the even any other vehicle may be effected by this movement." The cause of this collision was determeined by drvier's statements at the scene.
The truck company insurance denied my claim. With this conclusion on the traffic report will I be able to sue for damages to my vehicle. My insurance company will not pursue the issue, they will make the repairs if I pay the deductable.

Yes, you most certainly have a claim. The question here will be the damages. If your damages are significant, you will be better served by a competent attorney. However, if you are only claiming damage to your car and if it is less than $7500, then you should go to the small claims court.
