Legal Question in Traffic Law in California
Verified Complaints, Bail and Failure to Appear
I appeared before a commissioner in a traffic case, repeatedly requested a verified complaint orally and in writing, and was denied, and was charged with failure to appear after I told the commr I wouldn't pay bail and left. 1) Aren't I entitled to a verified complaint? (VC 40513(b),Heldt v. Muni. Ct.) 2) Can they compel ''bail'' in this situation? I can't find any authorities that say yes. 3) Can the commr put an unsigned complaint for FTA into the record (which he did)? It all seems like a serious violation of due process to me, and I don't think they ever had jurisdiction. Am I wrong?
