Legal Question in Traffic Law in California

Will I lose my license?

I was involved in an accident where I was being chased by someone. He got ahold of me once and punched me and tried to drag me from my car. I was trying to get to a main road and away from him so I shut my lights off but then I was so scared I went through a stop sign and hit another vehicle. The guy who was chasing me saw all this and took off. I was charged with failure to stop and headlights off after dark. I only had my license for a month when this happened. I told the cop about being chased but he said if I persued that then he'd charge me with reckless driving also. Plenty of people saw the guy chasing me but the cop said he didn't want to hear it and it had nothing to do with the accident.

So, that being said, what are my chances when I go for my hearing? I'm an honor student, have a job, have never been in trouble; will any of that matter? Will I end up losing my license?

Re: Will I lose my license?

You need to discuss the facts of your case with an attorney. The necessity defense is very difficult to successfully present to a jury. The present charges are much less serious than a charge of reckless driving with an injury, which has a mandatory license revocation of, as I recall, 90 days. It is no upto the police officer to determine what charges are to be filed in court. However, the request of the police officer would carry considerable weight with many da's.
