Legal Question in Wills and Trusts in California
1063(d) If there is specifically devised property, there shall be an
additional schedule accounting for income, disbursements, and
proceeds of sale pursuant to Section 12002 and subdivision (a) of
Section 16340.
Does this apply to an executors first account and report; or could the executor tell the court "i'll supply the schedule with the final accounting." ?
16340 (a) (1)......and by making a reasonable provision for amounts the fiduciary believes the estate or terminating income interest may become obligated to pay after the property is distributed.
This is confusing, as a property is not to be distributed without debts cleared. Could this include known impending estate taxes and penalties?
