Legal Question in Wills and Trusts in California
1) How long does an executor of a will have in order follow up on this person last wishes.
2)my step'mother sead that she is ready to go to court, & she is not going to anour my fothers last will & test.
3) what can we due ? & what should we not due !

There is no set "time requirement" only that it be reasonable. Generally, a Probate is started for someone with a will (or nothing at all) within the first couple of months, but I have seen people take years to file.
If your father actually made a will and your mother is not willing to honor it, then the Court will most likely not be very pleased with her.
You need to make sure that you have representation for your best interests. Of course this means retaining an attorney that specializes in Probate. THe fees for the attorney will be paid out of the Probate at the conclusion of services.
