Legal Question in Wills and Trusts in California

Can you help me?

i have an 8 yr old son. his dad died 1 and a half yrs ago. his dad lived with a woman for 5 yrs. she has yet to send any of my sons dads belongings. do i have grounds to go to court for probate?

I assume he and the other woman were not married. Do you know if he did have a Will and who is named the executor and who are the beneficiaries? If he had a child with the other woman, whether or not he was married to her, the child is considered as being equal to your child for division of any assets.

Contact the other woman again, be nice to her, tell her yo know she feels hurt, etc., slowly bring in that your son would like to have some items to remember his dad by so could you take them off her hands, arrange to come by to pick them up and to sit with her a while to let her vent, try to find out if Will as otherwise may have to go through probate as person without Will.
