abandoned child wants a claim on Dad'd estate

My dad left mom and I when I was seven. Never saw him again. Just found his death certificate on the web. How can I learn if his will has been probated. The court will not tell me. What if there was no will? How do I proceed? The widow may no cooperate.

Your dad's estate, such as it may be, must be probated in the county where he resided. You can check with the clerk of the probate court, or county court if the county doesn't have probate courts, to see if an estate has been entered in probate. If not, you might consider an application to determine heirship and take your portion of your father's estate as if he died without a will.

Forcing the issue may be expensive. Do you have reason to believe your father had an estate worth fighting over?

Where was your father, Texas or California. The laws of that state will prevail.
