Legal Question in Wills and Trusts in California

No accountability from the "administrator"...

My Gram died this past year and my uncle (the eldest of her two children) says he is the administrator of her will & trust. He has provided no documentation, however, and his disposition of Gram's estate is questionable at best--Gram was very vocal and specific about certain things, and of course, my uncle denies knowing anything about those requests. My folks have asked that I help them obtain documentation (my uncle refuses to speak to my Dad.) How and where do I begin?

I am sorry to hear about your grandmother and the problems surrounding the estate. Probate Code Sec. 16061.7 requires the trustee of the trust to mail a notice that the trust exists to the beneficiaries and anyone who would inherit if the trust did not exist. That should include one or both of your parents. The statute also requires the trustee to make the trust available to that same group of people. There are very strict time limits, however, and you should move quickly or contact an attorney right away. I hope this helps.
