Legal Question in Wills and Trusts in California

First Accounting of a Trust

Our trust went to litigation and is now being closed out. It's time for the first accounting and I would like to know if that first accounting is presented to the judge ''first'' or if it's presented to the trustee ''first'' and whether or not the trustee is allowed to dispute or make changes.

Thank you

Re: First Accounting of a Trust

First, thank you very much for your question. Unfortunately, it is very difficult to give you any suggestions based upon the information you provided. Normally, it is the trustee, and not you, who provides an accounting to the beneficiaries. If the court took jurisdiction over the trust (which it seems it might have), then the trustee is to provide an accounting to the court for approval. If the trustee sued you for an accounting, then I would provide that accounting to the trustee. If there is a court order, then comply with the court order. Please give me a call if you have any further questions.

Sincerely,
