Legal Question in Wills and Trusts in California

Adult With Autism

What type of autism would an adult of 51 years old have to have in order to be declared a ''minor'' by the state of California? Depending on this classification and the severity of the disorder would this ''minor'' adult be legally capable of living independantly,

holding a full time job, driving a motor vehicle or considering adoption of a foster child?

Re: Adult With Autism

You are talking about a conservatorship? Don't think he's declared a "minor" under any circumstances if he's 51. If he's unable to care for himself, then I think you're referring to a conservatorship. I could be wrong, so you might want to take this with a grain of salt.

Re: Adult With Autism

I think your question is what would be necessary to result in a conservatorship being established. Some interest party would have to petition the court and the adult would be able to resist. Ultimately a judge would have to decide after appropriate expert testimony and evaluation.
