Legal Question in Wills and Trusts in California

need advice about probate conservator

My stepfather is trying to have himself appointed probate conservator for my

mother. This goes against what my mother stated she wants. My sister and

myself want to stop this from happening. We just got the letter a few days

ago stating that is going to court on Febuary 14th. We have not been able to

find a lawyer willing to help us on such short notice.

My stepfather has made some very bad choices regarding my mothers care

such as cancelling her long term health care insurance AFTER she was

diagnosed with Alheizmers and refusing to get her the medical help she

needed. We also think he has transfered two cars out of her name and into

his own after she got sick.

We want to get the court to delay making a decision on the 14th so we can

can have time to find a lawyer and get prepared.

We are not trying to gain control of my mothers assets we just want to make

sure that my stepfather doesnt spend all her money and then leave my

mother broke and not able to pay for her care.

Re: need advice about probate conservator

You should file an objection with the court, and perhaps a petitionof your own for conservatorship.

Re: need advice about probate conservator

You should object to the appointment of your stepfather as conservator, preferably in writing, but in any case no later than the hearing. If you need representation, please contact me as soon as possible.
