Legal Question in Wills and Trusts in California

Afidavit of Identity

How does one obtain an Afidavit of Identity to access or obtain accounts of deceased that are listed in a trust but do not have trust listed as a beneficiary. There is one High Interest Bearing Savings account and the contents of a Safety Deposit Box. These are at two seperate institutions. My husband is both a sibling of the deceased and a Co-Trustee.

Try a Certification of Trust. That one might work.

If the trust is not listed as a beneficiary and the account is not in the name of the trust you have to probate the assets. I believe I answered your question in a phone call.
