Legal Question in Wills and Trusts in California

our apt manager left a note on our door yesterday saying she doesnt have record of us paying rent in sept 2008 so it seems kind of random. can they charge us still 3 1/2 years later? wich were sure we paid it back then we just dont know if we have the proof.

If you have a written lease, they can collect for up to four years back.

I agree with Mr. McCormick. If your rent was under the terms of a written lease, then they can sue you for unpaid rent within the past four (4) years. The limitations period would be shorter, however, if it was an oral lease, that continued from month to month.

If you paid by check, you should be able to still order copies of your check scans from your bank, which should show if the check was made, and cleared. If you paid in cash, however, you may have a problem if you didn't get a receipt or lost the receipt you were given.
