Legal Question in Wills and Trusts in California
Attorney fees for extraordinary services
We are finalizing a probate proceeding we are not disputing the stat. fees of 2550.00 but our lawyer is charging an additional 8750.00 for ''extraordinary services'' my stepfather had a second morgage on the property in ? before probate even started he signed a waiver and disclaimer acknowledging complete respon. for the debt and waiving any rights to the property, we submitted it to our original probate lawyer and it was nvr filed w/the courts as a disclaimer, this was my mothers seperate property, per interspousal grant deed and we felt he no longer had the right to encumber the property our new lawyer buckled and we settled paying a portion of the debt now he is charging 8750.00 to settle a debt of 20,000.00 of which we pd $5600.00 to clear. The final dist. papers include these fees how do I dispute these fees with the court? I have not signed the paperwork yet Im afraid if I do Im agreeing to the charges, what do I do?

the charges sound extremely high. dont sing anything until you have another lawyer look at the case.
