Legal Question in Wills and Trusts in California

Aunt died in October 2010. Uncle inherited if he outlived her by 30 days. He is about 87 and is going back to Spain. My aunt had bonds and savings over a couple million dollars. She was one of 7 children last one to die. They listed us cousins 13 in all. They have hearing in CA 9 in the morning. Can we contest the will and get our mother's share ? Do we have to do it at time of hearing? Thanks... from Ruidoso, NM

Unfortunately, you haven't given enough information.

It appears that you want to file a will contest which would assert that the will is not valid for some reason.

You will need to file objections to the probating of the will and file an appropriate contest.

I HIGHLY recommend that you contact an attorney in the general vicinity of where the probate has been filed in California to review any documents that you have, discuss the facts and tell you the options available to you.
