Bank accounts in mine and my deceased grandmother's name
My Grandmother, who raised my sister and I,m died three weeks ago. My Grandfather is still living, but has Alzheimer's. My aunt discovered that my Grandmother had opend bank accounts in mine are my Grandmother's names with over $30,000.00 in them. My aunt has requested that I sign the money over to her so that she can take care of my Grandfather. I am not sure if the money will be used for thia and want to know what the laws are in this situation. Please help me.

I am sorry to hear of your loss. If you wish to claim the money then an investigation into the nature of the bank account is necessary. Also if you grandmother died intestate, you may need to assert your rights to the the funds. Call me directly at (619) 222-3504.

from the facts given so far, it is probably in your very best interests to set up a support trust for your grandfather with the monies in the various bank accounts that include your name on them, if in fact you want to support your grandfather and make sure you know how much is to go to him every month. this way you do not "need" to give the monies to your aunt and rely on her doing "the right thing" on her own. you should designate a legal trustee to do this instead to ensure that what you want to see happen does in fact happen in respect to support of your grandfather. if you would like further legal assistance and/or trust set up information, please email me directly with how you might like to proceed. thanks for your question, and we offer our deepest condolences to you regarding the passing of your grandmother.
