can a bank continue to charge the monthly service fee after being noticed of account holders' death in california since you must wait 40 days after Date Of Deceased's passing to close and withdraw remaining funds?

Since the bank is still providing the same services as it had before and the restrictions on closing the account are not of its own making, why should it not be allowed to make the charges?
