Legal Question in Wills and Trusts in California
As beneficiary to a trust I need to obtain a copy and information on the administration but my sister refused my request. Is there a time limit after my relative's death to get these? My sister has led me to believe she has honored the trust and it is final, completed in full (not sure the correct way to say this???) But my relative told me a few things would happen with his property, etc. when he died and nothing did. My sister has taken everything, home and sold it, belongings, money with the exception of one account that had my name on it. She is now doing the same thing with my aunt's estate and telling me that there was not a will to be found anywhere although my aunt told me exactly where she kept it. I don't know what steps to take but I do feel I am being played for a fool. Help PLEASE!
1 Answer from Attorneys
When it comes to wills and trusts, people often learn the hard way that trusted relatives turn out to be anything but. Get yourself to a lawyer in your area immediately. There might still be ways to handle this, such as filing a petition for an accounting, and compelling distribution. In addition, the attorney can assist you in demanding a copy of the trust, to which you are entitled. Run, don't walk!
