Legal Question in Wills and Trusts in California

if my brother died in calif. but had a death benefit from his Union in Nevada for $10,000, his estate is under $20,000, and I'm his only surviving family, if I complete the Calif. Probate 13101, after 40 days, will that be sufficient to claim the death benefit from his Union in Nevada? Should they accept it?
