Legal Question in Wills and Trusts in California

My brother is excuter of father's property. He died 12-13-2007, had no will. My brother said he would take care of Dad's burial. He has not! He has all required paerwork, and has ignored my calls all this time. Meanwhile my dad's ashes are somewhere out there. I have proceed wth Veteren's affairs to obtain the paperwork for his burial. . There is personnal property (housefull of furniture, car ect.-- things my Mom had (she died 2003.Dad sold house, and walked away with about $250,000. My brother has kept everything.. I feel have waited long enough. What should I do?We are his only children. Approximate value of personal property, at $20,000.
