Legal Question in Wills and Trusts in California
Claim from Executor against beneficiary after Probate Closes
The executor of my wife's grandfater's estate distributed funds early. Costs then exceeded what remained in the estate. We were unaware of this. Nonetheless, a month later the court closed probate based upon papers filed by the executor's attorney. Two months later we received a dmand to pay nearly $1000. We are refusing claiming the probate case is closed. We are now being threatened with Small Claims Action.
Are we obligated to pay?

Re: Claim from Executor against beneficiary after Probate Closes
This may be the executor's problem, unless the court's final order had a provision requiring the beneficiaries to return money--look these over and see what authority requires you to pay the shortage.
