Legal Question in Wills and Trusts in California

Can I collect on a deceased parent's estate

My father abandoned my mother, my three siblings and myself back in 1961 (when I was 3; I am now 43), he never paid any child support and never contacted us again. I know he is now deceased (DOD: 1989, I obtained a copy of his death certificate) and I am wondering if I and my siblings can ''lay claim'' to any part of his estate. He was survived by a wife.

Check the Superior Court in the county where he died in and see if a probate was filed. If it was, get a copy of the court filing have it reviewed by an attorney. If no probate was filed and you think there might be assets you would be entitled to, you might consult with a probate attorney about filing a probate yourself.
