Legal Question in Wills and Trusts in California

How do I go about getting a conservatorship for my father? What documentation do I need? I have a letter from his doctor, a power of attorney giving me power if "he is no longer able" and a trust agreement that makes me executor in the same case.

There is a whole set of forms on the Judicial Council's website: http://courts.ca.gov Go to the forms tab and use the pull down menu to find conservatorship forms. If your county has a Probate Court self-help clinic or office, I STRONGLY recommend availing yourself of their services if you want to do this without an attorney.

The forms are on the court's website. There are also local forms for each county as well as local procedure. A letter from the doctor is not enough to be apppointed. Also, you have to explain to the court why the trust and powers of attorney are not sufficient. I handle conservatorships in your area if you would like to discuss the procedure.

If you have a durable power of attorney and you are the successor trustee to your father's trust, why is a conservatorship needed. You need an attorney to review the papers you have and your father's situation to determine how best to proceed. I am available for a free 30 minute consultation. If you want my assistance please contact me at 916-925-6005.
