conservatorship guardianship

My fatherinlaw is in an alzheimer's unit. My brotherinlaw had durable power of attorney before putting his father in the nursing home. Both father and son were on the checking account so that brother could pay the nursing home monthly rent. There is no other property.Just monthly social security that pays the home. My brotherinlaw died suddenly without putting anyone else on the checking account. Can my husband fill out and file the conservatorship paperwork ourselves without an attorney and what is the proceedure?
