Legal Question in Wills and Trusts in California
Contesting the accounting of estate
My spouse died four years ago and the Will left everything to me. Other family members contested the will, but I settled with them and paid them off already . During the contest a special adminstrator was put in place and has had control of everything . She has stone walled me every time. I know that she has done thing to deprive me of monies. Example she was collectiing rent money on property that she had already title to me. She has prepared a final accounting and I now see that she paid for things that are wrong and she listed my separate( prior to marrage) things in the accounting I have not signed any papers to include my items and she did not list any thing as community property. Since I am the sole heir I have asked her for all documents to review and the ledgers. She has told me that it is client attorney privledge. Now she said that she will give me only the things that are in question with me.
Are all working paper in the estate confidential?
I would like to Know who does the attorney work for her or the estate ? The estate is paying for the attorneys fee and I am the sole heir. Can I get an order to make me the executor like the Will says and then gain access to all the records she has for the estate?

Re: Contesting the accounting of estate
You have a lot of good questions. It would take some time to properly address all of them, so it can't be done in this post.
It may be possible to remove the current executor, but I would need more information. If you'd like to schedule a one hour consultation, call my office.
