Legal Question in Wills and Trusts in California

Can I get a copy of a Trust

I just found out the my father, who is in serously failing health, has a Trust in CA. Can I get a copy of the Trust without going through him?

If he should pass away, you are entitled to a copy of the trust, should it become irrevocable at the time.

You would request the copy from the successor trustee within 120 days of death.

If you don't want to ask him, you can ask the trustee (assuming it is someone other than your father). If there is another person and he or she won't give it to you (and you can't get it from someone else), your only possible recourse is to sue him. Alternatively, wait until he passes away and you can obtain a copy when the trustee sends out a notice of adminstration.
