Legal Question in Wills and Trusts in California

What county for probate

My mother died recently in a different county from her legal residence. Do we have a choice where to file her will or does it have to be where her legal residence was?

Re: What county for probate

You would file it in the county of legal residence for a full probate. There are some probate procedures where you can "forum shop" but a full probate is not one of them. It should all be by mail anyway so not a big deal. Get a good probate attorney! Good luck!

Re: What county for probate

County of residence upon death is generally the appropriate venue for filing probate.

You should contact a probate attorney in the area. There should be several in Santa Barbara. I too can handle a probate in Santa Barbara as I am in Ventura County.
