Court Approval of Attorney's Fees

In Superior Court, Probate Division, Burbank, CA., must the attorney submit his bills to the court prior to billing the client?

This depends on the type of matter and type of contract with the client. In most probate and conservatorship cases, the attorney fees for the attorney of the executor or conservator must be approved by the court before the attorney can be paid by the client.

Attorneys for beneficiaries or other parties do not usually need to have the court approval unless their fees are being paid by the estate or trust.
