A court order for the bank?

My mom passed away with a small bank account. We have her death certificate, and my brother has legal trust. The bank is saying they need a court order to transfer funds to his account. Is this correct? Do we need a lawyer to handle this?

If the estate is under $100,000, this can and should be handled outside of the Probate Court system. A lawyer could assist you in this process for a minimal fee and/or you and your brother could handle it with the bank.

If the estate is small I would suggest that you purchse NOLO PRESS book on probate, it will show you exactly what you need to handle a small estate.
