Legal Question in Wills and Trusts in California
My dad died on December 10th 2009. He was single and I am his only child. My uncle has my dad's will dated Sept. 2009 that says my uncle is the sole beneficiary and it's signed by witnesses and everything (I've never seen it).
My dad lived and died in California. My uncle and I live in California. Do I have any right to contest it? My dad told me in November 2009 that he made me the sole beneficiary, but I never saw it and don't have any idea where that will would be. My dad lived with my uncle so I have no access to his belongings.
My uncle calls me several times a week to warn me that everything is his and I don't get anything. I haven't made any attempt to get anything, but now I am considering closing out my dad's bank accounts and keeping that money (less than 50,000 I'm guessing) when it is 40 days.
What are my rights? What could happen to me if I did that?
