my dad had nothing

My Dad died 6/29/01, unexpectedly. The only asset he has is a vehicle worth less than $1,000. There is no will. My sister and I are the only survivors. We want to sell the vehicle to help pay for the funeral. He owes a small amount to the IRS and Social Security/Disability. Is there a simplified probate process? Who will get the money first, the creditors or us? Are we liable for his other debts beyond the value of his assets? Should we just do nothing and let the creditors take the vehicle?

There is a simple way to avoid probate on small estates like this. You need a particular type of declaration that any lawyer can write for you for about $20.
