Legal Question in Wills and Trusts in California

My Dad just died in WA without a will. My stepmom refuses to give me anything of my fathers. I am my fathers only child and heir. Do I have any action or rights to what my fathers left behind? I live in CA, if I am entitled how do I go about persuing action?

You may, but it depends on the details of your father's estate plan, if he has one, and how all of his assets are titled, and whether or not he has any separate property.

If, for example your father's will leaves everything to his wife, and it may very well do so if they've been married a long time, then there's nothing you can do.

If you are going to retain a lawyer to represent you, get one in Washington, as there's little credibility to a threatening lawyer letter from an out-of-state attorney who can't file a court petition on your behalf in Washington.
