Legal Question in Wills and Trusts in California
My dad past away this April and I am the named successor trustee for his living AB trust. I am supposed to distribute his real properties to my sons as well as my to brothers. According to the probate code, I should file an affidavit of change of trustee? After filing the affidavit of change of trustee, can I just execute the grant deed to the beneficiaries immediately? Is there a time limit of which I have to complete the distribution by. It has been more than 5 months already, when is the deadline for the distribution of trust properties?

I would advise you to hire an attorney to assist you with Trust administration. There are legal notices that should have been sent by now. In addition, the Trust needs its' own tax ID # and tax returns must be filed. You want to make sure before you distribute the assets that there are no creditors, including Medi-Cal.
