Legal Question in Wills and Trusts in California
Debts of deceased spouse
I'm in California, my spouse passed away after a long battle with cancer. We have substantial medical bills and credit debt in his name only. What is the spouse responsible for. We held real estate jointly. Can they require that we sell our property. There was no will or life insurance and there are children.
thank you

Re: Debts of deceased spouse
As spouse, you might be responsible for your late husband's medical bills. But, I'm pretty sure your creditors cannot force you to sell your primary residence. I urge you to consult a qualified debtor/creditor attorney to find out what your options are.
